We're suing both of them because the messages came from her house and some of them from her e-mail address (Diane, you shouldn't have lied to me on the phone...). Therefor, we'll pursue both of them. Sure, John is likely hiding and working under the table, but she's not. She's a 53 year old homeowner with a regular job. Not a good move on her part to default on a lawsuit.
