I used to work in LC so I know what we could pursue on or not. ERAC cannot pursue on many things becuase of a law suit that happened a couple years ago. Now things have to be collision related. ERAC cannot pursue on diesel, acts of God, and can only pusue up to $500.00 in vandalism, the rest they eat. You guys have many great ideas on how to get back at ERAC! I love it! I am going to rent a car this weekend! |
Great info here. Can you elaborate more on the $500 limit in CA? I am an ERAC customer/victim. While parked at shopping center, returned to car and had minor damage to the hood. Looked like a SUV with a trailer hitch backed into the hood in the parking lot.
Returned vehicle and explained damage and what occured. There was no accident. Was asked to sign CC authorization for $500. Signed and left. Never heard anything from ERAC and never charged the CC.
Now I have a collection account on credit reports for $1500? Not sure who it is for, never had a collection and all my accounts are at zero balance. FICO scores were 740 ish before this collection. I suspect this is from ERAC. The collection agency has not responded to my Debt Validation letter and they have violated several sections of the Fair Debt Collection Practices Act (FDCPA) so I have them on several violations that will cost them $1K each.
I am not that interested in suing this idiot collector at the moment, just want to find out who the collection is for and get the issue resolved. If it is ERAC I will pay them the $500 if it is legit, but $1500?
Like I stated the collector has never responded with validation of this debt so I don't even know who it is for, but that is how I found this website becasue on only one of my credit reports the Collection Agency lists as the original creditor: ERACCARSON and I had no idea who the hell that was! This website came up under ERAC, so here I am and the rental is really the only plausable explanation for this collection. Any help or suggestions in dealing with ERAC would be great. Are there numbers somewhere for loss control? Thanks!
