Default No Paperwork or Walk-Around Claim

My brother's vehicle was struck by another car and required repairs. He used Enterprise as my rental car agency. He was originally issued a Nissan Altima, which I later switched out for a Dodge truck. Paperwork & a “walk-around” was completed on the Altima, but not the Dodge truck. When he checked the Dodge truck in, an Enterprise employee noticed a dent in the bumper, and my brother informed them it was present when he I received the vehicle and that no paperwork or walk-around had been completed at that time. The Enterprise employee indicated this was not a problem. However, my brother is now being harassed by a bill collection agency (American Recovery Systems Inc.) for $585.60 regarding the damage to the truck.

In fact, when my brother told American that there was no paperwork...they got back in touch with him later and said they did have paperwork. What they had was the original paperwork for the Altima with some handwriting on the bottom regarding the Dodge truck. My brother has his carbon copy from the Altima showing the document American has is forged.

Any suggestions? I don't see how they can charge him with damages with no paperwork?

Get an attorney. Forgery is no laughing matter. And, I would send a big brick through the window for good measure for your time wasted on this matter which is clearly ERAC's fault.

I'm curious as to why your brother did not walk around the truck when he got into the vehicle and ask to have paperwork regarding the car, especially when there was damage on it.

Well like I've said in countless messages here, honey. You can avoid all these problems by buying the fake insurance from Enterpuke. Then those theives cannot try and fuck you out of youre hard earned money. And more importantly, you can do what ever you want to theys car and just drop it off and say "Here's you shitty motherfucking car back, loser". That's more or less what I say on Mondays when I dump off my weekend special car back at the branch near me. I try an be a little nicer when I say it but sometimes Mondays is just so hard, well I am not so nice. hehehe

I'm glad to see that others refer to CDW as "fake insurance" as I always did. That's all CDW is; nothing more, nothing less.

oh well, saved my ass one time when some 7 yr old lost control of his bike and put the deepest scratch on the side of a taurus (whole length of the car too.) that i'd ever seen in my life. didnt cost me a thing. looked to be about 3,000 worth of repairs. oh well, not my prob.

Try to keep up. You are handed a carbon copy of the altima rental. When you switched out vehicles to the dodge truck, they usually cross out the vehicle information and have you initial. It's still a contract and your copy is now just the completed version of the altima contract. Why are you/your brother retarded and didn't do a walk around? He obviously knew he was supposed to? If he saw the damage, why didn't he report it? Oh, that's right, he noticed it 4 days later. Quit bitching and pay the bill. Nobody likes a deadbeat.

You know how they make you initial for the condition of the car when you first go there?
Well in order for the contract to be legal and binding the renter would have to initial for any vehicle switches. If the walk-around was not performed for the Dodge truck and no one initialed for the car then Enterprise does not have a leg to stand-on because the consition of that new vehicle was not acknowledged. Furthermore, if you were the one who switched the Altima for the Dodge, and not your brother, then again Enterprise is liable, because the primary renter is the only individual allowed to do the switch. If anyone else initials for the switch then that initial is bubkus. Finally, if the scumbags over at Enterprise forged your brothers initials (and they do it all the time, because when I worked there I was told to do it almost daily) then all you have to do is prove that the two sets of initials do not match, simple enough.

Don't listen to the jack ass who posted before me, calling you a deadbeat and all. The people who work for that company are completely brainwashed. Eventually he'll come out of his green haze, to the world he hardly remembers anymore. He's probably just mad because it's his branch and it's gonna hit his uninsured losses in 22 days.

You think for a second he just walked in and they handed him the keys to the new car at the counter? Of course he initialed for it. Just because it's not on his pink copy doesn't mean that the vehicle switch was not signed for. You're dumb as a mule if you think otherwise.
