It is a gray area because the people are different (renter and his spouse), but in most states the entity is the same (the marriage). In principle, the renter should not be held responsible, but they are trying to pursue your wife. Two suggestions: Contact the Area Manager of the branch. Most are gate keepers that want to resolve any problems before they go higher up. Second, if your frequency of rental is more than this 4 days this year and you truly purchase DW, make it a point that you always purchase the protection. ERAC loves insurance purchasers and they want to keep you buying more of it in the future. Essentially, DW is a gamble. In this case (and again in principle), the customer won and ERAC should cut their losses. You are likely dealing with an overzealous loss control coordinator who is trying to make his/her collection numbers for the month.

A smart branch manager or area manager would recognize that this only costs his/her office $83 a month to pay off and would lobby for loss control to let the customer off of the hook. That's about the cost of a lunch to a few service advisors. Sheesh.

I'm curious of the outcome... let us know what transpires.
Good advice. I'd prefer property damage at an ERAC lot, but lets give your method a shot first.

tee hee! Robert was the coolest kid in school, and he has such a great life! Nevermind the fact that he is on this site 24 hours a day, only getting up to get some twinkies or to take a monster shit. I am glad you found an outley for all of your frustration that life has thrown at you. Now only if people outside of the screen in front of your fat, ugly face respected you!

He must say something that bothers you, otherwise you would ignore it. Is he the biggest Enterprise RAC basher on this website?

For those of you who posted advice, THANK YOU!

This situation hasn't been resolved but I will work on it this week and I will post a followup.

I think the fatal error made by the poster was telling the ERAC employee that his wife bumped into the car. You should have just told him/her that you don't know how the damage happened and left it at that.

I opted to purchase the CDW at $24/day for about 4 days. I've rented from this location before and I've always opted for the CDW.

While I had the car, my wife backed into it while it was parked in our drive way. This cracked the driver's side head light lens and scuffed the bumper.

We returned the car, explained the situation, and was told everything was okay. Two weeks later, we received a letter requesting about $600 for repairs.

I called enterprise, explained the situation, and was told that they are not trying to get the payment from me but from my wife. I explained that since we're married, they're ultimately trying to get the payment from me. They agreed to review the case.

Now, about five weeks later, I received a bill for over $900 for the repair. Really -- there was not $900 worth of damage to the car.

At this point, I'm looking for a lawyer to handle this.

Does anyone have any advice? Am I screwed? Will I have to pay the $900?

Thanks in advanced.
Hiring a lawyer is hardly a smart thing to do especially considering it would cost you ten-fold the amount in question to hire him/her. You should have never mentioned that your spouse hit the car. ERAC will always pursue a 3rd party if on is given. Next time, drop the car off, tell them you don't know what happened, and leave it at that.

You should tell them they have the report backwards. You hit your wifes car, she did not back into you. That way if you took SLP and CDW Enterprise will have to pay for the damage on your car and your wifes!!!
