His wife was driving a different vehicle you fucking retard and YES ERAC will go after the person who caused the damage which in this case is your wife. You have nothing to stand on. You can always get a lawyer BUT you will just be paying his/her fees PLUS the cost of the repairs. Now of course I would also check to see why the cost went up but they will probably feed you aline of BS like interest or something. They are basically charging you for soft costs (admin. costs.)

come on man you got to wisen up. why the HELL would you tell them your wife hit the rental car??? thats just asking to get F'ed in the A by enterprise. i've probably rented 50 rental cars in my life, damaged about half of them, most of the time while viloating the terms of contract, and everytime the accient report is the same: "renter returned to the vehicle to notice it was damaged. renter is unaware of how it happened" gimme a break

I've talked to a few lawyers about this. Ultimately, none of them are interested in taking this on as a case.

Since then, Enterprise has turned this over to a rude and aggressive collections agency.

I've called up and down the chain of command at Enterprise with no positive results.

My main point is this: If they do have the right pursue the money from my wife (ultimately me), it is at their discretion. They know that they are ultimately holding me responsible for the damage but if they have a way to circumvent the CDW, they will. They're choosing to turn the screws on a once loyal customer.

At this point, I don't have any recourse but to pay the full amount. In the meantime, I'm going to send the details to The Consumerist (The Consumerist: Shoppers Bite Back). If anything, I think people should know how Enterprise treats its customers.

RECOURSE? How about OBLIGATION? RESPONSIBILITY also comes to mind. I wonder why no attorneys want to take your case? BECAUSE YOU HAVE NO CASE! Stop whining about something that you are responsible for and pay up! We have already been through this in a previous post:
ERAC is going after the person who hit ERAC's car, not the person who rented ERAC's car and took CDW. CDW releases the RENTER (not the third party who hit the ERAC vehicle) from responsibility for the damage, but then ERAC goes after the person who caused the damage. It doesn't matter if it is your wife, son, daughter, grandmother, mistress, hairdresser, mailman, dentist or whoever. THE PERSON WHO WAS BEHIND THE WHEEL OF THE CAR THAT BACKED INTO ERAC'S CAR IS RESPONSIBLE FOR THE DAMAGE. That person just happens to be the renter's wife. I'm all for socking it to ERAC, but this one is your wife's fault, not ERAC's. Stop using your wife's fuck up and your inability to understand a simple concept to bash ERAC. Reporting them to "The Consumerist" for this makes you look like a crybaby deadbeat who won't take responsibility and pay what you owe. There are many things ERAC does wrong that warrant mentioning in a consumer beware forum, but this time the customer is WRONG.
