Update: Maureen Ringrose, senior loss coordinator for Group 48, said in her letter that ERAC would turn my “bill” over to a collection agency on Feb. 20. It’s March 8 and I have not gotten a call or letter from anyone. I planned to return to the attorney if I ever did but it seems someone in Group 48 got some sense or they are being slow or they were bluffing. In any case, I stood my ground and am glad I did.

Just because you haven't been contacted from the collection agency doesn't mean ERAC did not turn your bill over to them. The loss department may take a week or two to actually hand over your file to the collectors. From there, it may take some time to get assigned to an actual collector.

Best to send a copy of the Maureen's demand letter to your attorney.

Well, I don’t have someone I’d call my attorney yet; I haven’t paid him a fee and put him on retainer. I’ve just spoken to an attorney who I would if I had to. He’d get $900 and more before I’d give anything to ERAC.

Thanks. I’m still a little bit mystified. There are groups and guides and conventional wisdom to getting out of debt and dealing with collection agencies (and sharks who play the same role like Ringrose) for people who’ve overspent because they have a compulsion problem or just tried but couldn’t make ends meet. This is so peculiar. Many kudos to this site.

I think ERAC must have a sour corporate culture. They took that car to two mechanics for some explanation on how this obvious malfunction could be my fault, and then ran with them. It says a lot that they came up with one explanation, expected me to pay based on it, and then scrapped it for another. They didn’t care how insensible it was; it just had to lead back to me. It all echoes the site administrator’s letter to Steve Weidner of Group 51/Tulsa on the main page.

I’ve been in crappy financial situations before because I had a screw up or some bad luck. I can handle those. This kind of white-collar harassment is a new one for me.
