Default scammed

I was recently scammed myself by an Enterprise. The car I rented was backed up against a major highway that made you walk real close to the car, there was damages I didn't see under the back bumper (they didn't offer a mirror). I am now being charged $400 for something that happened before I got the car. When I confronted the employee that original walked the car and that now found these scratches he agreed that when walking close like we did you wouldn't be able to see. These are not my damages. Now what are my recourse?

The first thing you should do is stop being a little bitch and handle your own issues. How does that sound? Call the manager or wait until you get something in the mail from the loss control dept (you probably already have) and tell them to look up previous contracts for the damage. Now in reality the only way to know that the damages were previously there would be if you actually did see the underside of the bumper (which does not require a mirror you just stand back and squat) but anyways those r your options. Other than that you are fucked.

First, jerk..... how do I know they had the car fixed. second...... how do I know they didn't do this very thing to the person who rented before me. They gave me no proof. I DIDN"T DO IT. Yes, any idiot would know by what I wrote that I did get something in the mail that is why I know how much they want me to pay and they probably looked up previous renters but what good does that do unless they tell them they damaged the car and get a confession. Give me a brake. Also, there is no need for nasty language, jerk. I guess there aren't many honest people in the world today are there.
I have never had an accident or ticket in my 52 years of life. So now I know that anyone can charge you with an accident. This is the first time I have rented a car ever in my life and it will be my last. I am damned angree at being charged with something I know I didn't do and I have no recourse.
Here is something else to think about. I was never offered to purchase any insurance, and since I never rented before didn't know I could until I am reading other threads. what gives with that?

Have their loss control pull old rental contracts to see if the damage was marked down previously. And one thing enterprise employees are trained well on is offereing the coverage. That's kind of odd that no one tried to sell you any damage protection.

The employee that waited on me didn't offer any insurance, at the time I was the first of 6 people renting cars and there was two employees registering. They picked us all up at the airport because this was off site car rental. After walking withing 3 feet of the car all the way around he took me in and told me sign here and initial in these three spots and your out of here. He did ask what my insurance company was and wrote that on the bottom of the copy I received. Like I said I never rented before in my life so I did what he said and left. Aslo, this bill for $400. came from a differant Enterprise rental then the one I rented. This rent-a-car was a good hours drive away from where I rented.
I will do as you said and ask them to look up old rental contracts to see if damage was marked. Thank you.
I just feel so violated.

Well that just about blows away evey misonception out there about Enterprise doesn't it? "They didn't offer me protection" HAHAHAHAHAHA That is soooooo funny. Here everyone bashes on Erac for pushing protection too much and now that it is not offered, bam, so Erac is damned if they do and damned if they don't. I do see your point about the missed damage, and maybe it was there, maybe it wasn't, and it is unfortunate you will probably end up having to pay for it. Sorry, I can't stop laughing about the whole not being offered protection thing....

Didn't mean to ruffle those feathers there slick (okay yes I did). If they never offered you coverage then bring that up with either the Area Manager or City Manager/Regional Rental Manager. 1) They are obligated to offer it to you and 2) if they find out an employee isn't even trying to sell CDW then they will get pissed and probably get some retribution for you. As far as getting the letter from loss control yes that was obvious but what I should have put in there was that even if they cannot blame someone else THEY CANNOT BLAME YOU GENIUS (I call you genius by your obvious ability to spell like "angree, give me a BRAKE it's called spell-check gramps) and the purpose of looking up old contracts is because if the damage is notated on the previous contract it shows that the damage was there PRIOR to you renting it hence you and your 52 years of clean driving experience could not be responsible. See the good thing about this site is that you can get some good information; the bad thing is that it can come from assholes like me. The office the letter came from was probably from the corporate office where they have the LC department. Call that paper pusher and tell them to check old tickets for the damage.

The thing I can't believe about your post, the original poster, is that ERAC did not offer you coverage. Yea right. That is like saying the person at McDonalds didn't ask if you want to super size that. This almost makes me think you created the damage, and are looking for another way out.. Do not fear....As long as you have the employee on record saying that other cars impeded walk around you will be fine. If I was the BM, I was for 3 years, I would check previous contracts and most likely throw it out. Especially, if I have some stupid , no good for nothing MT that is saying he goes along with the 52 year olds story. With out that you are royally screwed, and you can be sure that you will have $400 less for your monthly medicine.

Just to set everybody straight. I am not a liar and 52 years old is not old. Wait until you get there and you will know. Thank you everyone who has helped me know which direction I will go.

You are very welcome. Even though my suggestions came with a little venom I was trying to lead you down the right path. As long as you know 100% that you had absolutely nothing to do with the damager (scraping a curb, parking block or homeless person's body) then you have nothing to worry about when judgment day comes. Good luck in your plight to right your wrong and god speed my YOUNG friend.

PS. I called you old because I thought you had posted 52 years of driving not "life" as you had posted and for that I apologize. Of course you wouldn't have a ticket in the first 16 years as you did not have a license and back then chariots were much tougher than today’s cars :-)
