it has happened to me and an ALLSTTE INSURANCE AGENT WITH IN TWO WEEKS OF each other at different locations in OHIO.they seem to be running a scam. IN JULY 2006

Actually, it doesn't matter what the signs say in the parking lot at all. It matters what ERAC told the customer BEFORE the contract was signed. Even then, a court of law in Ontario may well deem the damage to be ERAC's responsibility, based on case law dealing with standard business losses through damage. For example, retailers in Ontario cannot make customers pay for shelf goods unintentionally damaged by the customers - e.g., jar of pickles slips from customer's hand and breaks.

It is not a legal stretch to extend this to include a car damaged on the lot after a customer has returned it and thus ended the contract. After all, ERAC is well aware, by years of experience and thus acknowledgement, that lot damage is just part of the cost of ERAC doing business. Indeed, a judge may well decide that since ERAC knows afterhours lot damage occurs that it falls upon ERAC's shoulders either to continue accepting the damage costs as a standard business loss or to provide round the clock security to protect their property. That fact that ERAC does not generally and certainly not universally engage round the clock security measures is, in itself under Canadian law, an admission by the company that it is willing to accept a certain degree of financial loss through lot damage.

Of course, all of this could fall on one very simple fact at issue: When exactly did the damage occur? If it can be proven that the damage occurred during the rental contract, then the customer is responsible to pay for the damage.

At any rate, good luck with this. You may well have to cough up $500.

The contract does not end just because the customer parked the car on the lot. The contract ends when the contract is closed in the computer.

When I worked for Erac, i worked in C3 (ottawa). If this person is a student, odds are they are under 25. If this is the case, all rentals in C3 for under 25's have a 500 deductable, with no option to purchase a 0. Also, odds are that the vehicle was damaged overnite in the lot. In C3 they have signs all over that say "if you drop, you are responsible until we check it in" As shitty as it sounds, you're right, the damage probably wasn't your fault and something you didn't do, but you're still responsible for it


I am 26, I was never given an option of 0 deductible insurance. I bought all the 3 types of insurance which she offered. What more am I supposed to do?
If someone has damaged the car in the parking lot, how can they hold me responsible for that? If someone had totally wrecked the car, are they going to charge me the price of the car, which maybe more than $20,000????
I asked her that, she told me, even if the whole car was damaged I would still be charged only $500 b/c that is my deductible. I just feel like going and smashing that car right now, b/c they are behaving like mafia extorting money from students for damage I havent done. I dont even know what dent they are talking about, they havent sent me any pics, nothing. Maybe the dent was already there when I rented the car, maybe it was done by someone after I returned it, the next customer. And then they charged me 2 months after that on my credit card, with no notification, nothing. The lawyer says she sent a mail on Oct 11 to my old address. But I always had a forwarding address set up, then how come I did not get it? And I had rented the car on Sept 1st, Oct 11th is still too late to send a letter abt damage. Why didnt they call me on Sept 2nd if they thought I had done some damage? I could have gone there and told them that I had not done any damage and they are lying. I am not going to pay them anything. If they want to go to court, thats fine with me.

The only other way they would have charged you a deductable is if you rented a Van/truck or SUV. If you didn't, then you're a bloody liar. Cause if you are 26 and rented a car, I know for a fact they don't even offer a 500 deductable insurance, it's all zero

I am 26 NOW, I was 25 last Sept when I rented the car. And yes it was a car, Chevy Impala.

If you want to believe this, then go ahead. The contract ends when the car is returned, at least under the law (statute and case) in Ontario, Canada.

sorry champ. You're 100% full of shit. I worked in C3 for 3 years and they never had anything other than a Zero deductable (except those instances that I mentionned before) Have fun paying for the damage you obviously caused since you're a filthy liar. 25 and still in school huh? Obviously not that smart either.

don't know about his situation, but a lot of people start college late, others take off a few years to work during college, and yet others are in grad school.

personal attacks based on faulty assumptions are never a good idea.
