| Hi, About a month ago, a group of friends and myself rented a Truck from ERAC for a camping trip up in the mountains. Well, the car we wanted wasn't avaliable but they had just got a red Ram returned 15 minutes earlier (because the lady "didn't like the way it drove") that we thought would work out great. Well, the truck was substantially damaged on the driver's side rear end and, during the walk through, the rental lady said that such damage was common to trucks because they tend to get "beat up" during use. Naturally, I didn't believe this, and I had her list it clearly in the contract I signed. Upon returning the truck a week later, they proceed to give me crap about the truck damage. I pull out the contract and show them that it's clearly marked. And no, I didn't sign a damage report. Now, I get this bill in the mail today for $1600 in damages, all of which they said I caused, and all of which are CLEARLY visible on the contract I signed when I first took possession of the car. I've tried several times to get someone, ANYONE, in loss control or even a manager to no avail. Anyhoo, where should I go from here? Should I get a lawyer and, if yes, where do I find one that deals with this sort of thing? Thanks for your help, folks. |

| All you need to do is get a hold of their loos control, explain whats going on. Let them know you have a copy of the contract that shows the damage marked. They may ask you for a copy but you should be free and clear. If not hell yes get a lwayer. |

Tailfin, it's one thing going the attorney route if you've already exercised normal communciation, taken it up the line of command, and still had no success, but it seems like you throw the "I'm going to report you and sue you" line at any company that you feel that you are being wronged by right of the bat. I wonder how much time (yours, whatever company you are suing, the lawyer you hire) you have wasted by simply resorting to the quick draw lawsuit approach rather than just being a reasonable and rational human being and resolving it with simple communication. | People like you who cannot handle their own business and ask lawyers and court systems to do it are the reasons why so many companies have to create red tape and processes that take so long because there are worries about being sued. Be a fucking man and go through the process yourself and don't waste the time of small claims court, company lawyers or whatnot. Face he fact that you are a cheapskate and people hate you because you do whatever you can (ethically or unethically) to get the cheapest price. You are the type of person who would bring up the fact that in 1982 you spent 58 cents per gallon for gas so you should still get that price today because you have been going to the same gas station for 24 years and not understand why you have to pay the same as everyone else. Filing small claims does not make you this "badass" you are trying to be. You can't even restore your piece of shit car probably because you are trying to haggle the price of parts and see if you can get them for 1959 prices.
