Default Scratch below bumper on curve of valance

I recently rented a car from Enterprise while another car was in the shop. Upon return we were told that scratch had been found.. A small scratch approimately 2 inches long could be seen if you knelt down or bent over and looked on the valance beneath the front bumper. (I have photos that enterprise sent me). I agree that a scratch is there but believe that due to the location and the how minor the damage is that both the rental agent and I missed it on the inspection. I believe that you would have had to knelt down or bent over for the damage to catch your eye as you walked around the vehicle. Neither I nor the agent bent down and suggested that I do this at the time of inpection. Enterprise did check the previous inspections and the damage was not noted previously to this but once again I think that it could easily been overlooked as I had done.

I did not hit anything nor park in a location that would have led to this damage. What are my options to contest this? The repair cost was 125 dolars plus a 50 dollar admin fee. I know that is is small but I do not feel that I did the damage and think it is reasonable that it would have been missed 9 times out of 10 when a walk around inspection was done.

Ask if they can waive the admin fee if you send them a check right away for the actual damage. Other than that, you have to pay.

Even though the damage was in a location that reasonably would be missed Enterprise will hold me responsible?

If I refuse payment what is the process taken by Enterprise? Will it go to colletions then I have to contest or do they go to small claims court if I refuse payment? I am curious as to what the next step in the process is if a refuse to pay this claim. What additional admin fees may I be responsible for? Any details on the process to see if it is worth challenging over the principle of this being easily missed in an inspection would be appreciated. Who within the branch should I raise these concerns too? Loss Manager?

To anyone faslely accused of damage upon return, just ask to re-rent the car on the spot and take full cdw, then drive the car into the wall.

This will only cost one days rental as opposed to the repair charge.

For $200 they probably won't send it to collections. They'll continue to send letters and call you. If you don't pay, they'll put you on the "Do Not Rent" list and you won't be able to rent from ERAC again.
Call the loss control administrator that sent you the subrogation letter. If you don't get anywhere ask to be transfered to the loss control manager. If he doesn't relent, ask if he can take the fees off and 25% of the damages. 25% is what they would have to pay to a collection agency anyway so they may as well pass the savings on to you.
ERAC's position here is, it's not up to the ERAC employee to catch the damages prior to you renting the vehicle. It's equally up to you since it's a contract you both signed.

you mayn have to bite it, even though you might not have done it, who looks under the car for damage?? Did they use the e-tool when you picked up the car and when you returned it?? I would refuse to pay it if I were you, if you have problems, ask for the city manager of the admin office phone number, the higher you go the better your chances are of you not having to pay for it. If it is a 2 inch scratch under the car, the person checking in the car is prob just a prick, any damage under about the size of a fist is not repaired. Also make sure that the car has not been rented out after they checked you in, if it was rented again ****YOU DO NOT HAVE TO PAY FOR THE DAMAGE**** it could have happened with the next renter, this is a huge LEGAL ISSUE within E crap. If they rented it out after you FIGHT IT ALL THE WAY TO THE TOP. if you are forced to pay the repair, get proof that they actuallt fixed it and did not just pocket the money!!!

Enterprise is now offering to only chrage half the amount. I really have an issue paying anything considering I do not believe I am responsible for the damage. The original amount was 175.73 and the new amount is 87.86. What is your take on this change of amount or liability percentage in the damage claim that Enterprise is offering?

You may as well pay the half. Doesn't sound like you are 100% positive that the damage was there when you started. Up to you though as they will probably make you a Do Not Rent victim afterwards if you don't pay.

I have a family member in accounting, and he said they send people for collections for small amounts like the $87, so you should take it to the top, or just pay.

Your friend in accounting is talking about sending customers to collections who don't pay their rental bill. Sending people to collections for damage to a vehicle is a loss control issue, and I've never sent anyone to collections for an amount that small. Our group policy was not to send anyone to collections unless the amount was $250 or above.
