I just got a notice in the mail informing me that i'm being sued by enterprise. I've been checking around here and i've come to grips that hey I may be screwed but I wanted to get some of ya'lls opinions. I was reading a post from a manager i believe, and the same thing happened to me. I basically got lost in the car, banged it up with about $2000 worth of damage, found where I had left the car a day later, and called enterprise who came and picked it up. I had also lost the keys, which, as i've heard voids the insurance policy and so on. BUT Also from what i've been reading enterprise isn't supposed to take debit cards for payment, and that is exactly what i used. They withdrew $500 dollars for the deductible at first which i understood. A few days later they withdrew $1000, this was before I found the car, i had reported it lost to them. I got that money refunded but never the $500 which if the insurance policy is void then there should be no deductible and/or that money should go to the repairs. My question is this, with the lawsuit pending, should I fight it, call their attorney, or leave don ross a long voicemail that he'll probably laugh at and delete?

As a former employee (been gone 4 months now) and worked 4 years in rental, 3 in the admin office...I laughed my behind off at this one. To answer your question......you don't have a case. You rented the car. OK. Got lost. OK, that happens. Smashed up the car. Not really OK, but accidents happen. Abandonded the car. Not Ok. Lost the keys. Really not OK. No police report? Extremely not OK. You pretty much voided your contract when you abandoned the car. ERAC can make you pay for all damages as opposed to the deductible. ERAC can take debit cards for payment. It's not a preferred method, but you can. When I was in rental, we had customers secure the rental with their cc and pay with their debit card upon return. Some used their debit cards for the length of the rental. I mean you can call Don Ross (who retired) and complain if you like. It may make you feel better, but it's not changing the situation any. Sorry! |

Sure, you can give the attorney a call. I just don't want you to wind up possibly wasting your time. I do wish you good luck though in regards to whatever happens.

you did the crime, now do the time. what the f-uck does using a debit card have to do with ANY thing you did with the rental card? i'm sure in your mind it was a 'credit' card anyway because it 'had that logo on it.' don't waste money hiring an attorney. it will make your debt worse.

Back when I used to bleed green, I had a "customer" like you. Rented by debit card on a weekly basis, which was fine. I tried calling each week to make sure they were aware I was going to run the credit card again for another week, and left a message on the machine. Finally after about a month, the card ran out, and the customer was QUICKLY able to get in touch with me. Not because the card declined, it ran clean through EVERYTHING they had, but because the bank told them they owed THEM money. Then the old bat had the audacity to say I couldn't charge her but for one week, because thats what she signed for, and additionally, that she had dropped the car off 3 weeks ago. Somehow I had lost it. I told the bank manager what the car was like and amazingly enough when the silly goose left, she climbed into a car looking EXACTLY like my rental car with the same plate and even a little green E on the trunk. I was amazed at the coincidence, since she had only had it 1 week almost a month ago, and had dropped it off since then. Then that customer came in and gave me a sob story. And I had to check it in, and found damage. And the customer told me that I had ruined their life. That a 70 year old woman was being taken advantage of. Then she went off the deep end, claiming she was personally called by Mr. Rumsfeld and went to Iraq to translate Farsi for the troops and was spirited away in the night for this secret mission, and had been there for several weeks. So she didn't know how any damage came to it, and it was likely done while it was sitting at my lot and I couldn't find the car. She was bat shit crazy, totally responsible and so are you. ERAC might be a lot of bad things, but this is NOTHING that has to do with Enterprise and everything with you being an irresponsible shitdick. I pray that this some sick joke by another former employee who is getting a laugh out of this. Any other company I would assume it was, but I do remember what level of intelligence I saw day after day step through the doors at Enterprise. I'm just surprised inbred dreck such as yourself could find the power button a computer, let alone figure out how to spell and complete sentences.
