Default Serious Question

My cousin was riding his bicycle down the highway and someone turns into a restaurant parkinglot right in front of him and he runs right into the car causing $1200 damage. Turns out it is an enterprise rental. Now he is stuck with $2000 medical bills and enterprise is calling him saying he owes for the damage to the car. He ran into the passenger door yet enterprise is claiming that he also owes for rear bumper damage. Go figure. The police report doesn't really put the blame on anyone though. Has anyone ever heard of something like this or have any experience with it?

I am former BM and it is the renters responsibility to pay damages to ERAC. (renter accepted damage responsiblity when they rented.) Even if it is a clear cut case that your cousin is at fault, ERAC would still pursue renter. Eventually renter will try to collect from cousin I'm sure. I would tell ERAC to go pound sand.

You've left a lot of facts out of your description to give an accurate response and it would be too lengthy to ask all the relevant questions. Suffice it to say, with the facts that you've given, and I hate to recommend this because they are blood sucking leeches, he needs to lawyer up asap.

Not if the renter had dub. ELCO would also go after the third party for damages in either instance.

Dude, I'm being very serious here but I did lie about one thing. It was a Hertz rental and not an ERAC car. I just said that cause there's not a failinghertz website and the two companies are very similar. What I was thinking was that the customer had their damage waiver and Hertz was going after my cousin to get their money. But even at that, does Hertz have a leg to stand on? I was just wondering if anyone had ever seen something similar to this while working at ERAC or at Hertz for that matter.

Does anyone else think its funny that someone has to post the title to a thread as "Serious Question". Apparently nothing else on this site is taken seriously so if somebody actually does have a legitimate question, they have to say that in the title.

I LOL when I saw the title of this thread. If that doesn't tell Admin something, nothing else will.
