That is the smartest thing said on this forum. Life after ERAC is much better, trust me. Why would you want to be in retail the rest of your life. I was a BM and even when I took days off, my branch would call me at 5 times a day. You can never really get away from that place. How would you like to worry that every Thanksgiving/Christmas holiday, there is a chance you might have to work. When you are the BM, it is your responsibility to fill in, even if you had time off. Get out now, if you are worrying about lunches, that is only the least of your worries down the road.

I'm just speaking my truth, I didn't say it was "the" truth. I know you'll be labeled as a whiner if you threaten, but my note did say you SHOULD bring it to his/her attention. Talk to your manager reasonably. If you're not getting them, I'd assume your coworkers aren't either. see what he/she can do.

The problem is that I have already brought it up to my BM and ARM. BM says its just how it is and ARM says that its my fault I don't just leave and take a lunch.

ARM said " just leave and take a lunch." When you come in in the morning tell your manager you need lunch at noon. Then at noon "just leave and take a lunch" Any questions tell him to talk to the ARM.

PS - get a new job.

Just taking lunch doesn't seem to make up for all the other crap I have to deal with.

Federal law is:
Every 5.5 hrs, 30 min lunch...
Every 2 hrs, 10 min break...
So every 8.5 hr shift one 1/2 hr lunch and two 10 min breaks...
Legally you cannot work through your lunch break even if you wanted to because of the liablity that you could come back later and say "I was not given a lunch"

You can ruffle feathers and get paid to shut up if you can provide proof and or have a witness that you were unable to take breaks while on the clock.

The time card changes are kinda tuff to prove unless you have to sign them before they are sent to payroll.

Federal law clearly states that there is no required lunch break or any break for that matter. You might be surprised what is not required under Federal law. Go check it out at dol.gov. It is very informative. I think the most likely violation of Federal law is in the area of overtime. There are some rules regarding breaks if breaks are allowed. For lunch breaks, meaning at least 30 minutes of real break time provided by the employer, there is no requirement for compensation during that period. However, if an employer allows for general or coffee breaks of 5-20 minutes, it is considered compensatory time.

Some states have laws that require various breaks to be provided to employees. In addition, union contracts usually stipulate break requirements. Unless your state has, or passes, a statute requiring breaks, the company is not required to give them. Having said that, prudent business practices would clearly include allowing people to have breaks. If you are going to give your best effort for the "team", the team leaders should want you at peak form during the "game" and breaks allow people to rejuvenate during the day.

If the managers at this company think social bonding is so important, maybe they should consider requiring "team" walks together, or something else, instead of drinking. It certainly would be more healthy, and probably create more positive attitudes. Of course, you cannot corner a coworker to subject them to inappropriate advances on an office walk with others as easily as you can in a bar.
