It's interesting how everybody is under the belief that lunch and breaks are required by law. I had checked this out a while back while working for another company, and was shocked to learn that only like 11 states have laws requiring lunch breaks, and where I am (MO) is not one of them. I also found the overtime stuff interesting since my husband is still getting screwed by the "Big E", but that's a whole different story.

I always found it so funny how erac operates in Canada. Most of the brass are Americans who've transferred in. Now, please don't think I am knocking Americans with this, because I am not impuning an entire nation of people, just some of them who are with erac. Anyhow, these Americans bring the US-centred corporate culture with them, and that includes legal knowledge, however imperfect. The laws can be remarkably different between countries. For instance, in Ontario employers must provide employees who work an erac day with one half hour lunch and two fifteen minute breaks. Also, a break must be provided for any shift worked for three hours or longer. Think about that! This means that if you work a Saturday and start at 8:30 a.m., you are entitled to a break at 11:30 a.m., which is a half hour before close. The implications for staffing are incredible, in that if employees hung together -- and they won't because the are too afraid or too sheeplike or both -- they could force the company to put two people on shift on Saturdays where normally one person works the Saturday.

i usually work from 9-12 but then sometimes they will tell me that i have to ""RIDE"" with someone to get another car from some place else,
thus making ME get back to my branch later then usuall

my ""somewhat"" female companion was a little ticked off because i had told her that i would be home around 12:30ish, but no,... i got home around 2:30ish [[insert angry face here]]

i had dropped off a customer, came back, my boss told me that HR was in there and wanting to talk to me

they asked me to tell the truth....
i mean they alrerady KNOW what i did...

and then her and that balding guy had me go outside and then inside and then outside and then inside

fuckers!! i wanted to know what they said

so, they called me back in and said that i wasnt allowd to come back here

so, i grabbed my stuff, ((hose nozzele and squeegie THAT I BOUGHT)) and left...


i also told my OWN BOSS that is was fine while i was there

now i miss it

Yea, them penis wipes always changing your stuff WITHOUT telling you. And, making you work without a lunch break, and just because they buy you a slice of pizze, take 30min. away. What's that all about. Somebody shoot me. Oh yea!!!! I don't work there anymore. YEEEEEEEEEEEEEEEEEEEEEEEEEA :)

You must be a lawyer because only a lawyer could read a federal statute and completely pervert what it says and doesn't say.

An employer is not required to PAY for the time taken for lunch it is uninterrupted and away form the employees duties. They are however required to pay for BREAK depending on what has been stipulated.

Not to mention state laws that re-inforce this. Also because ERAC employees work outside, inside, in all weather, work in vehicles, there are more factors on their side.

Across the board the US courts are siding with the employees of many companies that are filing for compensation suits. I wouldn't e surprised if this guy was some ERAC lawyer trying to scare people away. If you are owed overtime, and not getting lunch breaks, call a lawyer. If you don't then you are to blame not ERAC.
