I don't think it matters what state you are in. It is a violation of Federal Labor Law. Talk to an attorney. If you are not able to provide any proof, it may not be worth the time.

Unfortunately there is no federal law that I can find that governs breaks. You are better off checking state laws

Correct, there is no federal labor law governing breaks. In fact, unless a state law intervenes, you are not required to get a paid break or any break according to federal law. I thought the thread was about changing a time card. It is a violation of federal law to change a time card and not pay a person for time he/she was actually working. For example, a company has a policy of no overtime without manager approval. At a time when no manager is available, an employee determines that he/she should work overtime. The manager later says that was a violation of policy and we are not going to pay you for that overtime. That is a violation. The employee must be paid according to federal law. What the company does beyond that is the company's decision if it wants to discipline the employee; however, there is no choice about paying for the time. If an ERAC employee works x number of hours and a manager makes it look like x-some number of hours, that is a violation.

I had a death in m family and took my bereavement days and 2 choice days. Well, when I got my paycheck, my manager sort of forgot to log my hours for the whole week. Nice huh? Good thing I have extra money in my checking account, or otherwise I'd be screwed.

Just be careful with these pricks. If you smoke and go out for a couple of smokes during the day, they will try to say that constitues a break. They tried that shit with me. They said that when I got coffee and had a few cigs during the day, that meant I had my lunch and wasn't entitled to extra time. Complete bullshit! I can't wait until this makes national news.

Actually in the old ralph system there would be asteriks by the hours changed thats how you can tell when a branch manager would go in to Ralph and change your time. I think this is a company wide practice.

I experienced a fair amount of time changing on my sheet.

I worked in gp51 where we got paid very little, and in order to afford my rent and other expenses, and I used to BEG for extra hours from any of the offices in my town. I'd work as a MT, Car Prep, Driver, whatever.

So I used to pull down 65 hour work weeks. The HR guy hated me. But like I told him I couldn't afford to live any other way.

What I began to notice, is that my Branch manager was also being criticized by the HR guy for "letting" me work so many hours. So in order to compensate, my BM used to reduce my hours by 4 or 5 every week. It seemed that every week I'd have to scream and yell to get paid what I was due. Keep in mind, when I worked at other branches, everyone knew what I was doing. I always got it approved by the Area Mgr.

My first boss used to cut my hours too, but she did it because she was looking for a promotion, and didn't think I would notice during my first few months with the company that I was being shorted 2 hours or so a week. I guess she figured that whopping 14 bucks a week would make all the difference to her future promotion.
