Default Ever thought of suing over lack of lunch time

It is required by law in every place I am aware that a 30 minute break be given for every 8 hours worked. If you work at ERAC and do not get this regularly you have grounds for a lawsuit.

FYI, in Pennsylvania, that is not completely true. For full-time exempt employees (everyone from Assistant Managers on down at ERAC), the law only says that IF a break is given and it is less than 20 minutes in length, the employee MAY NOT be asked to punch out for that time. If the break is 20 minutes or longer, the employer may require the employee to punch out and not be paid for the break. The law doesn't state the employer MUST give employees breaks of any kind. I remember this BS b/c senior management is very good at training their BMs to exploit every loophole in employment law to push their people as hard as possible (and also to avoid lawsuits).

Not sure how this works in other states, you may be right about your assertion in other places.

Bottom line is, check your branch. They have to have the state labor laws posted in easy access to employees. If they don't, tell your loss control department.

Better yet call OSHA and the state labor department. If I remember right OSHA fines people $7G for every violation and all they need is one.

It may also be an idea to check your contract as those of us who work for enterprise have signed many basic rights away when we signed that thing.....

To one of the above posters, to be honest with you, the law DOES state that breaks MUST be provided you in the course of you employ. I happen to have a copy of the current and up to date fed specs on this subject in my office at my firm and can assure you that you are entitled these breaks. Fed law NOT state law.

There is no federal law mandating breaks..

Each state has its own regulations, and most of them there are no mandates.
