Default ERAC pleads guilty to 'wrongful death' of a customer

In this article, it details how one of ERACs customers in the US was killed in an accident and 5 other people were injured because ERAC rented him a vehicle with bald tires. A situation I think everyone who has worked in rental is familiar with! Enterprise's defence was that they dont train the car preps to check tires for wear and rely on services/warrenty schedules (which we all know never happens!) To make ERAC feel really stupid the wife of the dead man offered to provide each of the 1,330 branches in the US with a $2.50 tire tread guage using the proceeds from the settlement.

ERAC should be ashamed of itself!

Although there is really nothing funny about the article, the lawyer obviously didn't do his homework. He says "checking the tire tread should be done every time just like they clean out the ash tray and fill up the gas tank." He couldn't of ever rented a car from Enterprise as he would know that cars never go out with more than 1/4 tank of gas and you always get the pleasure of smelling like smoke after getting out of that Neon.

this is typical of the short sighted approach by erac, dont do things properly, then try and chuck some money at it when it goes wrong, and lets face it, with the bald tyre isses it was only a matter of time. i have personally seen dozens of vehicles over the years with illegal (ie less than 1.6mm) tyres which had been on rent. At least i can say with my head held high that i got this sorted out each time I saw it, but erac need to face the music and change the system overall, ie-why dont we make the tread part of the check out sheet? most other rental companyies do this, and subsequently dont have blood on there hands when corner cutting at senior levels goes wrong....wonder what would happen if this were to occur in the uK? with corp manslaughter it would get very interesting.

Whilst we are not trained to check tyres and other mechanical issues, these items are checked on every valet of the vehicle, i have personnaly brought worn tyres and other issues to the attention of office staff, only to be ignored and the vehicle rented.

On our check sheets there is a section relating to tyres, if this is ticked or the tread entered, then the person who entered this information is liable, regardless of been trained or not.

You may have noticed that on the check sheet you are meant to print and sign your name, if you do not print and sign you can not be held liable, my advice is only sign or print, not both.

Yes, i do work in the UK, before you make a comment, i am fully aware that i am a car prep, however, my relation is a top solicitor, some of the laughs we have about ERAC are real funny, but very seriose of course.

Was never going to make as comment. I actually totaly agree with you. If it was not for hard working car preps, then many branches would crumble.

I was fortunate that when I was a branch manager, I had fantastic car preps. They would always tell me about worn tread on tyres. Its just a shame that my twatty area manager would make me rent the vehicle anyway. My attitude was if I was forced to do it, then I would damm well make sure they were rented one way.

It is a shame that so many area managers show no respect to car preps, as without them, these area managers would be stuffed !!!!
