I was fired awhile ago, upon getting fired I filed for unemployment right away. I went through the fact-finding interview and gave them my statement as to why I was fired.

Later on the unemployment claims examiner said that they were fighting my claim. The examiner said that they wrote a letter that I lied about what really happened and he's seeing it as they're saying I intentionally caused the company a loss which is not true. I gave my rebuttal statement and the claims examiner said he'll make a determination in the next few days.

Has this happened to any of you where you would file for unemployment, ERAC would fight the claim even lying outright to do so?

They will always fight it. Unless you have commited a criminal act you will get it.

and three times i won
i laughed hard at that, complete satisfaction
i bet you win too, as long as you didn't steal anything or commit a crime

ERAC will fight every claim and probably win most of them (or so they say) they keep files of every problem or complaint on everyone in my group so they can fire u and get away with it....

When they fight your UI claim they have to back it up. The only time they will win (and you get nothing) is if you were fired for sexual harassment, theft, violence in the workplace, anything the law considers serious enough to be a crime.

If they keep files of every problem and complaint on you they have to be relevant to why you were fired. When I got fired I can sense that the UI claims examiner already had a bad attitude towards ERAC and I still got my unemployment. Even the letter I got with his determination said ERAC could not substantiate unethical behavior and that they provided irrelevant information. They tried to appeal three times only to not appear (by phone or in-person) when the date came up.

ERAC can do whatever they want but they are not the law. If you get axed and they have stuff on you ask to see it. You have that right.

As long as you didn't abruptly quit or get fired for something criminal (theft, sexual harassment, assault) you will get your UI benefits.
