I was "let go" from ERAC. I filled for unemployment. I got it but they fought it 4 times, but I was able to win it 4 times. If you make them look bad enough you will win. I did it, and I got a 6 month paid vacation.

You'll have to tell your story a few times, so make sure you keep your story straight, and use everything they did wrong to you to your advantage.

If your position was eliminated it is recongnized as downsizing, therefore you would be able to file and you should be able to get unemployment. However, if they told you your position was being eliminated and offered you another position that is comperable to that one (same wages, similar job descriptions, etc.) and you turned it down then you may not be able to collect unemployment cause it is a refusal to work. Hope this helps!

You big lying load of crap. While not defending ERAC, I would bet ERAC was smart enough to send a copy of that letter to your state unemployment claims office to counter your dubious unemployment claim.

If you decide to quit going to your job, it is called job abandonment or for a simpler term..quitting. You get paid nothing for quitting.

It's fuckheads like you who are milking/clogging the system for legitimate hard working folks who have no where else to turn. Just remember, the state can come back at any time in the future and use "right of offset" to recover all funds paid to questionable beneficiaries.

yeah so don't lie to the unemployment people. you may win initially and start collecting money, only to have your case over turned on appeal and you have to pay the money back. so don't lie

You know, the lie that Enterprise tells you, that if you are fired you won't get unemployment, is a scare tactic that they cram down your throat to get you to stay, or quit "voluntarily" so that they can deny an unemployment claim. And Enterprise can fire anyone at anytime for no apparent reason, as has been illustrated by the many and varied stories on this discussion board. Just keep in mind, however, that you have to keep your ducks in a row, so to speak.

Any e-mails or documents that you receive regarding your performance, especially your reviews, can come in really handy if you are worried about termination/having to defend an unemployment claim. Most of the time, upper management and HR will try to intimidate you into leaving if you are on their shit list, but it is important to write down or record the conversations, in addition to getting anything you can in writing, so when the time comes, you can get your unemployment benefits with a lot less of a hassle. This worked extremely well for me. I had a lot of documentation pertaining to meetings I had with my Area Manager and HR rep that were so damning that I was collecting unemployment three weeks after I left the company.

Just remember that you have the power. Just like they are "volunteering" to employ you, you are "volunteering" to work for them. So, don't let it be a one-way street, dig?

I was terminated a few months ago and applied for unemployment. Once I served my waiting period (I had a few days wages & unused vacation pay) I did start receiving my unemployment which ERAC NEVER contested...AND will draw it for 26 weeks if I don't find another job!!! Good luck and fight them every step of the way if you have to!!!

~~Just to update, his position was eliminated because they decided to "outsource" his job. He was also on FMLA at the time, and they did not offer him another position. In essence, after speaking with an attorney, "E" directly violated FMLA rules and could, and should, be held accountable. I'm not sure where we are going with that yet, although he was approved for unemployment immediately and is doing much better healthwise. Although I'd love to hold them accountable, I don't know if it's worth the stress. They obviously have more money, and much better attorneys then we do.

Personally, I think the issues he was having medically was directly due to the stress related with the job, as he knew they wanted to close his department when all but him quit without notice.

Terminating a person on FMLA is a FEDERAL violation. Anytime a person is out on FMLA, disablity etc, they must return to work for 1 day and may then be terminated. Generally speaking, when out on FMLA or disablity, most employers do not have to keep your position open due to 'needs of the business', but when you return do have to offer you a similar job or term you at that time. You are the 2nd person that I know who was terminated while out on FMLA. FIGHT those bastards.
